CR-1 Spousal Visa Attorney Services
A CR-1 visa, also known as the Conditional Resident visa, is an immigrant visa specifically for the foreign spouse of a U.S. citizen. It allows the spouse to enter the United States as a conditional permanent resident. The "CR" stands for "Conditional Resident" because this visa is granted on a conditional basis for those who have been married for less than two years at the time of visa issuance. The visa is valid for two years, after which the conditions on the residency must be removed to obtain permanent resident status without conditions.
Eligibility Requirements
To qualify for a CR-1 visa, several requirements must be met:
- Marital Status: The petitioner must be a U.S. citizen and legally married to the foreign spouse.
- Legal Marriage: The marriage must be legally valid and recognized in the country where it took place.
- Proof of Relationship: Adequate evidence must be provided to prove the bona fide nature of the marriage.
- Background Checks: The foreign spouse must pass background checks and not have any disqualifying criminal or immigration violations.
- Medical Examination: The foreign spouse must undergo a medical examination by an approved physician to ensure they do not have any health conditions that would make them inadmissible to the United States.
The CR-1 Visa Process
The process for obtaining a CR-1 visa involves several steps:
- Filing the Petition: The U.S. citizen petitioner must file Form I-130, Petition for Alien Relative, with the United States Citizenship and Immigration Services (USCIS).
- USCIS Processing: USCIS reviews the petition and supporting documents to determine eligibility.
- National Visa Center (NVC) Processing: Once USCIS approves the petition, it is sent to the NVC, which assigns a case number and requests additional documentation and fees.
- Consular Processing: The NVC forwards the case to the appropriate U.S. consulate or embassy, where the foreign spouse will attend an interview.
- Visa Issuance: If the consular officer is satisfied with the evidence and interview, the CR-1 visa is issued, allowing the foreign spouse to enter the U.S. as a conditional permanent resident.
- Removal of Conditions: After two years, the couple must file Form I-751, Petition to Remove Conditions on Residence, to obtain permanent resident status without conditions.
